Union Minister Ashwini Vaishnaw introduced the Digital Personal Data Protection (DPDP) Bill in the Lok Sabha on 3 August 2023.
The Digital Personal Data Protection Act, 2023 was enacted to provide a framework for the processing of digital personal data in a manner that recognizes both the right of individuals to protect their personal data and the need to process such data for lawful purposes. It replaces the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. The legislation aims to create a comprehensive data protection regime that balances individual privacy rights with the requirements of the digital economy. It was developed to address growing concerns regarding data breaches and the misuse of personal information in the digital ecosystem.
The Ministry of Electronics and Information Technology (MeitY) is the nodal ministry for this act. The legislation is deeply rooted in the Supreme Court's landmark 2017 judgement in Justice K.S. Puttaswamy (Retd.) vs. Union of India, which declared the Right to Privacy as a fundamental right under Article 21 of the Indian Constitution.
